What Is An Uncontested Divorce?
An uncontested divorce is a divorce that involves both parties agreeing on the issues of property division, child custody arrangements, child support and spousal maintenance. If both spouses agree to the divorce terms, filing an uncontested petition can streamline the divorce process and save each side time and money. At our firm, it is our attorney’s job to make sure that all the right petitions and necessary supporting documents are filed. This ensures that the process goes as quickly and smoothly as possible so that you can move on to the next chapter of your life.
Helping You Meet Your Child Custody And Visitation Needs
For divorcing couples with minor children, who gets custody and when is often a major sticking point. Texas law divides custody into two categories:
- Conservatorship: Conservatorship refers to the rights and duties of the parents (decisions regarding schooling, medical choices, etc.).
- Possession and access: This refers to when parents have physical custody of the children and when they can visit with the children.
Conservatorship usually allows both parents to jointly make decisions (known as joint managing conservatorship), but if it is in the best interests of the child, a judge might give just one parent the right to make all the decisions (known as sole managing conservatorship). For possession, Texas has two basic standard schedules, but courts are usually flexible and allow the parents to agree on different schedules that work better for their specific families. Our family law attorney can walk you through this process and make sure that your family’s needs are met.
Knowledgeable And Compassionate In Mediation
Mediation is a frequently used alternative dispute resolution (ADR) method used to help resolve issues in divorce cases. Some counties (Travis County included) actually require that a couple attempt mediation before proceeding to a trial setting. In a divorce mediation, a neutral third party allows each side to present their arguments and attempts to facilitate agreements on all divorce issues. Although a lawyer is not required, having one present is the best way to make sure that your rights are being honored. Attorney Vy Nguyen has experience with divorce mediation representation and is committed to advocating for your interests throughout the process.
